OPEN LETTER TO PRIME MINISTER TO VISIT TO ELCHE. LET'S HELP


LAW COSTS OF 2008: A NECESSARY DEBATE
was stupefied by the representatives of the Ministry of Environment, led by the Director of costs, Alicia Doña Paz, Parliament has become to call attention to and condemn Spain and its government for the unjust application, arbitrary, retroactively and without sufficient compensation for the loss of property in cases of granting of the Coastal Act. There has been for nothing that director Costas body outside Parliament to explain this "wonder" is this law, besides being in the semester in which our President is also President (in office) of the European Union. Nothing, MEPs are in conspiracy against the Government, the National Court, Supreme Court officials and miscellaneous costs, indicating that the problem is not the law of costs (valid as the need to protect the beaches) but its application to situations that were (and are, in my opinion) law before the adoption, in 1988, that law
Parliamentarians in Europe, in short, are ratified as indicated in the famous (and forgotten) Report Auken and ask the Government to a solution that respects the property rights of European citizens.
For the Government could be time to reach a deal with citizens affected by the application of the law, insist on properties that were legal, opening a debate to try to combine respect for the environment and property rights.
We are going at it the credibility of this country and the confidence that this Government and its President in the first place, behave in a civilized manner with those who want to invest in it.
In this debate I would like to clarify some points from the perspective of those concerned, to avoid being disqualified opposition to the Coastal Act demagogic fashion that is sometimes made from their own side or from some lobbyists.
1 º) We are not against a law that protects the coast of urban riots. We are against that is used to change situations that were legal before the law. For us, the end justifies the means.
2) A democratically elected government has the right to change situations that are now considered "not it should have been permitted. " The procedure does not remove its property to the brave citizens affected, but "buy these properties at a fair price." This is what the civilized countries that adopt advanced laws. Another thing is what we usually do here, pass laws as the most advanced countries in social and environmental issues and lack of means to act as third world countries in terms of rights.
3 º) The compensation approved by the Constitutional Tribunal on the Law, to compensate the owners letting them enjoy a few years of his property that is removed by the state, it is ludicrous own economic illiterates. "Since where to buy something that is owned by another person can be paid "allowing" you to enjoy the property for some more time?.
4 º) Confidence in the government and the institutions of this country are at stake. The European Parliament condemned Spain for its lack of respect for the rights of European citizens and has asked to rectify. We believe it is in the hand of government to get it. To do this it should reform the Coastal Act eliminating the part of the same situations can be applied before the law with the Law on hand tomorrow if the government changes what is meant by the beach, extending the concept (as did 88 law regarding the law of 69), may leave in illegal back to thousands of families. It is this uncertainty that creates distrust.
Coast Neighbors Association of Arenales del Sol, which comprises 800 properties and families and the National Platform of People Affected by the Coastal Act that groups similar cases in Spain, we ask you, Mr. Prime Minister, that dialogue and negotiate with us. The force is not shown in the imposition and demolition, but the arguments and agreements. MEPs also look at this case as an example of the true state of mind you have.
